1. Do buildings need to be brought up to the current building code during certification or the Building Safety Inspection Program (BSIP)?

No — the 40-Year Recertification inspection is focused solely on existing structural and electrical safety, not code updates. Repairs are only required if they address immediate safety issues, not full code compliance

2. What happens if a building fails to submit the recertification on time?

Failing to submit a recertification triggers citations and escalating fines—potentially up to thousands of dollars per violation. Continued noncompliance may lead to liens or referral to unsafe structures enforcement boards

3. Who is allowed to perform the 40-Year Recertification inspection and submit the report?

Only a Florida-licensed structural engineer (and electrical engineer, where required) may conduct the inspection and produce a sealed report. Local authorities do not perform the inspection themselves and will only review the licensed professional’s findings
